Patent licensing entities and trolls often request patent license fees. Proper assessment of these requests is essential to determine whether these demands are real threats or overreaching attempts to extract licensing revenue. We counsel our clients on all aspects of patent defense including issues of patent infringement, validity and enforceability. And, under the proper situations, we render patent opinions of counsel regarding non-infringement, invalidity and unenforceability.
We identify for our clients any potential patent liability by assessing the strength of the patents at issue. Our technology provides a cost effective solution for prior art searches to support our patent defense work by identifying key prior art references. Our use of technology also aids in our ability to knock out threatening patents vulnerable to validity attacks. For example, we identify those patents suitable for subject matter ineligibility challenges, such as patents that may be construed as covered business method patents. Successfully and cost effectively identifying quality prior art references allows us to develop invalidity cases suitable for filing of petitions to institute proceedings for Post Grant Review (PGR), Inter Partes Review (IPR) and Covered Business Method Patents (CBM) proceedings at the Patent Trial and Appeal Board (PTAB).Freedom to Operate
Some clients want to move their product development into new areas and require an understanding of the patent landscape. We’ll identify any potential patent roadblocks for your product development particularly in those areas vulnerable to patent infringement suits. To this end, we conduct due diligence to counsel clients in freedom to operate matters. Using our Patent Analytics Technology, we uncover those hurdles that pose the greatest patent liability threat to entry into a new space. Using technology to identify the potentially problematic patents, we focus our legal efforts on those patents that pose the most significant risk to effectively counsel you to navigate the patent landscape.Patent Monitoring
We offer patent monitoring services by tracking issuance of patents from companies and in technologies of interest to our clients. We work with our clients to monitor issuance of strong patents related to critical technologies. Using our Patent Analytics technology, we automate patent monitoring services by monitoring newly issued patents at the USPTO and by classifying those patents into various technology areas. This automation allows us to cost effectively monitor newly issued patents of interest to our clients. We also put our Patent Analytics technology to work to find prior art relevant to those key patents.
